Dear John,

 

Per my public records request dated July 27 seeking a copy of the commercial parking lot license for 351 Summer Street for the VFW George Dilboy Post 529, the response provided indicates that no such license exists.

 

I request an agenda item bo added to the next Board of Aldmen meeting on September 22.

 

“That this board asks the George Dilboy Post 529 located at 371 Summer Street Somerville 02144 appear before this Board and explain why they are operating a Commercial Parking Lot at 351 Summer Street without the required City Permits”

 

Can you inform me if this request will be added to the September 22 meeting.

Mr. O’Shea, and other residents, addressed the committee and expressed concern that the parking area at the Dilboy VFW post is being operated as a commercial parking lot without the necessary permits. According to one resident, the DPW has been observed sweeping this lot and Mr. O’Shea believes that the owner of the lot should be paying the city for any services provided and should apply and pay for any necessary permits.

Mr. Nuzzo explained what evidence he would need in order to ascertain that the lot is being operated commercially and pointed out that this issue is a zoning matter.

Solicitor Wright will investigate what agreement(s), if any, exist between the owner of the lot and the City and he will also determine if any fire code issues exist.

Chairman Sullivan’s motion that the City Solicitor confer with the Fire Department, Planning Department and Inspection Services Department and contact representatives of the Dilboy Post for the purpose of determining the current use of the parking lot and obtaining any required permits, based upon the determination, was approved.

The City Solicitor has responded to Mr. O'Shea's communication. The committee requested that ISD determine the allowable number of parking spaces for the parking lot. The item will remain in committee until ISD supplys the requested information.
